This Privacy Policy describes what data the Loquify platform processes, for what purposes and on what grounds, as well as what rights data subjects have. By using the Platform, you agree to the terms of this Policy.
1. General Provisions and the Data Controller
This Policy applies to the processing of personal data when using the Loquify platform.
Loquify acts as the data controller with respect to the data of accounts and users of the Platform.
With respect to end customers' data uploaded by the Customer, the Customer acts as the controller, and Loquify acts as the data processor.
2. What Data We Process
Account data: name, email address, organization details, user accounts, and their roles.
Payment data: processed through payment providers; for cryptocurrency payments — crypto addresses and transaction details. We do not store full card payment details.
Technical data and logs: IP address, device and browser information, activity logs, cookies, and similar technologies.
Data uploaded by the Customer about their end customers: with respect to such data, Loquify acts as the processor and the Customer as the controller, determining the purposes and means of processing.
3. Purposes and Legal Bases for Processing
Providing access to the Platform and performing the agreement with the Customer.
Billing and accepting payments, including by cryptocurrency and bank cards.
Ensuring security, preventing fraud and abuse.
User support, improvement, and development of the Platform.
Compliance with the requirements of applicable law.
The legal bases for processing are performance of the agreement, the data subject's consent (where required), legitimate interest, and compliance with legal requirements.
4. Cookies and Analytics
We use cookies and similar technologies for the operation of the Platform, to save settings, and for usage analytics.
To determine the interface language, country detection by IP address may be used.
You can manage cookies in your browser settings; disabling some cookies may limit the functionality of the Platform.
5. Transfer to Third Parties and Processors
To operate the Platform, we engage third-party service providers (processors), including:
a phone trunk provider for telephony features;
a delivery service for arranging and tracking shipments;
payment and crypto services for accepting payments;
email, SMS, and Telegram providers for sending notifications;
AI providers for transcription, analytics, and reply features;
hosting and infrastructure providers.
Data is transferred to such processors to the extent necessary to provide the corresponding services.
6. The Role of Processor of the Customer's End Customers' Data
With respect to end customers' data uploaded by the Customer, Loquify acts as the data processor and processes it on the Customer's instructions and for the purpose of providing the Platform.
The Customer, as the controller, is responsible for the lawfulness of collecting and processing end customers' data, including obtaining the necessary consents and complying with data subjects' rights.
7. International Data Transfers
Data may be processed and stored on servers located in various countries, including outside the country of the data subject's location.
For international data transfers, we take reasonable measures to ensure an adequate level of protection in accordance with applicable law.
8. Retention Periods
We retain data for the period necessary for the purposes of its processing, performance of the agreement, and compliance with legal requirements.
After the retention period expires, data is deleted or anonymized, unless otherwise provided by applicable law.
9. Security Measures
We apply organizational and technical data protection measures, including encryption of sensitive data, restricting access on a need-to-know basis, and access control.
For fraud protection, leads' contact data is hidden from operators and managers; disclosure is available only with the appropriate permissions.
Despite the measures taken, no method of transmitting and storing data provides absolute protection.
10. Rights of Data Subjects
With respect to their personal data, a data subject has the right to: access the data, request its correction, deletion, restriction of processing, object to processing, and exercise the right to data portability.

If data is processed on behalf of the Customer as the controller, data subjects' requests are forwarded to the relevant Customer.
11. Children's Data
The Platform is not intended for persons under 18 years of age. We do not knowingly collect the personal data of such persons.
If you become aware that a minor's data has been provided to us without proper grounds, please let us know, and we will take measures to delete it.
12. Changes to the Policy
We may amend this Policy. A new version takes effect from the moment of its publication, unless another date is specified.
We recommend reviewing the current version of the Policy periodically.
